A Guide to Business Protection for Owners and Directors

In today’s tough economic climate, many SMEs face growing pressure to stay both profitable and sustainable. Business owners must manage daily operations while also putting strong governance in place to protect against unexpected risks that could disrupt even the best-run companies.

To prepare for the death or long-term illness of a business owner or key employee, you need expert advice. You can only make the right decisions when you fully understand the options available to you.

We understand that the success of your business effects your personal livelihood and your family’s financial security. As such, we offer a full suite of personal protection products, taken into consideration when deciding upon the most suitable balance of financial protection for yourself, your family and your business.

What is Shareholder or Partnership Protection?

Business owners must protect company ownership to ensure that if a shareholder or partner dies, their family receives fair treatment and the remaining owners keep control of the business. This type of protection plays a vital role in keeping the company stable and secure for the future.

A well-structured Shareholder or Partnership Protection plan allows you to transfer ownership clearly and tax-efficiently. A life insurance policy supports the arrangement by providing the funds needed to buy the shares, either from a partner who leaves due to illness or from the estate of someone who has passed away. Everyone involved knows exactly what will happen, which reduces uncertainty and eases financial pressure during a very difficult time. You have worked hard to build your business, do not leave this to chance.

What is Key Person Protection?

To protect your business, start by identifying who your key people are. This might not be obvious at first. Look at who handles essential tasks, manages important relationships, or contributes unique skills and experience. In many small businesses, job titles don’t fully reflect someone’s responsibilities or the impact of their absence.

Key Person Protection provides a financial safety net if one of these essential individuals dies or becomes seriously ill. The payout helps your business manage the loss by covering profit shortfalls, funding recruitment or temporary cover, repaying business loans, or giving your team the time and space to recover and adjust.

How Can Business Owners Protect Their Income During Illness?

Income Protection

Income Protection pays you a regular monthly benefit if you can’t work due to illness or injury. With a personal policy, you can receive up to 65% of your gross annual income, paid directly to you, tax-free. The insurer starts the payments after a waiting period, which you choose based on your financial needs. This period can be as short as day one or as long as 52 weeks, depending on what suits you best.

Executive Income Protection

Your company can take out Executive Income Protection on your behalf if you’re an employee or Director. This policy provides financial support if you can’t work due to illness or injury. It covers up to 80% of your gross income, along with your employer’s National Insurance and pension contributions, subject to policy limits. When calculating your income, the insurer includes salary, overtime, bonuses, P11D benefits, and dividends, even spousal dividends, which would stop during your absence. If you claim, the insurer pays the benefit to your company, and your company continues to pay your salary through PAYE.

Executive Income Protection can also include Pension Contribution Cover to support the cost of pension payments during your absence. Since auto-enrolment requires all employers to contribute at least 3% to employee pensions, this benefit ensures your business can keep contributing even if you’re off work. If you’re the sole employee, Director, and shareholder, this cover also offers a tax-efficient way to receive part of the benefit while continuing to save for retirement.
